If your employees belong to a trade union, probably collective agreement so called’ Collective Agreement”- with you. This contract covers wages, working conditions and procedures for complaining of problems at work.

Unless the Union workers covered?

It’s possible, because most unions bargain on the contract, which represents all other employees in the workplace whether or not they are in fact members of the Union. If an employee is covered by a collective agreement, but not a member of the Union, it is possible that the worker will still have to pay the Union a fee for negotiating the contract.

I need to provide employees a copy of the contract?

It depends. Usually contract coverage of your obligation to provide a copy of the contract employees. Often you have to give employees at least one copy of the contract.

Union treaty will limit my right to fire an employee?

Probably. Union contracts usually provide that workers can’t be fired, suspended, or disciplined without a good reason. This rule is usually found in the contracts, called Grievance Procedure or discipline.

In his book Sun Tzu and the Art of Business – Six Strategic Principles for Managers, Mark McNeill writes \”Like Sun Tzu’s Age of the Warring States, today’s playing world is one of continual offend between companies as they strive for survival and success across the globe. Faced with scarce and pricey resources and an ever-changing environment, competitors seek modify the slightest advantage.

The art of playing can’t be overlooked, but neither should the science of making strategic decisions supported on analytic data. Data-driven decisions should help to ensure that your decisions are sound and are aligned with your playing strategy, which should also be supported on keen market analysis.

Analytic accumulation should provide grave insights into market trends, your competition and modify your intellectual property management practice, which today typically governs two thirds of a company’s asset value. Because your IP composes so much of your company’s asset value, managing it using analytics is grave to the large effort of patent protection.

The theory has been in existence for some time but is rarely fully exploited, which – in the current economy in particular – is a mistake given the fact that it is increasingly more challenging to successfully compete. Analytics, particularly those related to IP, are a needed variable in the equation of playing planning and strategy. Understanding your IP in the context of market trends and your competition is grave in directing research and development (R&D), marketing and sales.

The following sections describe not only what we stingy by analytics in a more detailed way, but also the types of analytics you should be applying and ground IP analytics are so grave to your business. Simply put, analytics is the science of analysis, or more specifically in this case, patent analysis. When grouping mention analytics they are often referring to accumulation sets that assist them in making reasoned decisions, but the thing that makes these accumulation sets useful is how they are derived and how they are applied.

Almost always, they lead to a lot of pain and suffering, trauma and additional costs – all of which could be avoided, had the scrutiny staff been a bit more careful. In all such cases, victims can claim compensation.

Proving scrutiny no accomplishment and seeking compensation is a lowercase more complicated than proving no accomplishment in other personal injury cases. They also take more time, money and effort. However, many people are ease of the opinion that most scrutiny no accomplishment cases are fabricated. This is quite untrue. No lawyer module takes on a scrutiny any accomplishment case unless he’s absolutely sure of the case and the client.

Many people module agree that not everything can be measured in money; and that monetary compensation module not necessarily pass1 away all the pain and pain one had to undergo. Moreover, scrutiny no accomplishment is more serious because it involves a breach of trust. Patients trust doctors with their lives, and when that is betrayed, there is immense mental trauma. That said, compensation support some very credible purposes:

1. Firstly, it gives victims some jurally recourse in the face of the injustice done to them.

2. Secondly, it brings those who were responsible to task.

3. Thirdly, it sends out a social message of caution to the scrutiny fraternity.

4. Fourthly, it ensures that although you cannot get back what you’ve lost, at least you module not be continuously inconvenienced for the rest of your life.

This is precisely why lawyers are essential in the courts. When you really think about it the function of a lawyer is to serve and protect the public. They study the law so they can help you get out of trouble. Its things like this that has sparked a debate among philosophers for a long time. If lawyers can make an innocent man guilty and vice-versa, isn’t the law too complicated? Who knows the story better than the man himself? Why does he need representation?

There was a time when lawyers weren’t required but we view these as ‘simpler’ times. It’s no surprise that lawyers are now present in pretty much every courtroom encounter. Minnesota Criminal Lawyer are known for their resilience and educational values. They have among the highest success rates in the entire country. This is partially due to the strong emphasis that Minnesota Law Schools have. A presence which is almost un-rivalled by any other academic institutions in the country.

So when is it time to call a lawyer? Well when you’re at the stage where you understand there’s no getting out of this one. A good lawyer is worth a lot more than what you’ll be paying because of the charges that they deduct. In fact sometimes you only pay if you win, this of course creates an ideal environment as the lawyer is basically fighting for his money, and they’re going to have added incentive and motivation to fight for you.

What they often do is simply deduct the charges that you have to pay, for instance there are lawyers whom will help you fight parking tickets. You only pay them 100$ to get a 150$ parking ticket removed. The point is that lawyers are a very smart and powerful tool. They can make your encounters with the law much less costly and take care of all the papers and documents.

An Enduring Financial Power of Attorney appoints the Attorney to act on behalf of the Donor in much the same way as a General Power of Attorney, but it goes further and expresses that the Attorney has authority to act notwithstanding the incapacity of the Donor. This document has achieved much greater levels of acceptance in the business and general community.

It is possible (as is the case with a General Power of Attorney) to appoint one or more Attorneys to act jointly, or to act jointly and severally. It is also possible to attach conditions or limitations on the exercise powers under the Enduring Financial Power of Attorney and to impose time limits as to when the Attorney’s powers will commence and end or periods during which they will be operative.

It is often preferable in a family situation for an Enduring Financial Power of Attorney to be as flexible as possible and therefore that no conditions or limitations be imposed on the exercise of powers. However, there are also many instances where the Donor of the Enduring Financial Power of Attorney will wish to protect his or her best interests by imposing terms and conditions as to the use of the document.

A common misunderstanding also arises in relation to the expression “Financial” within the document as, although this expression is used, the applicable legislation does not confine the operation of the document to financial matters alone, but it can also cover most legal and business situations.

It is important to obtain reliable legal advice – having regard to your own individual requirements- as to the appropriateness of the various available Powers of Attorney for your specific personal situation. It may be that all that you require is an Enduring Financial Power of Attorney but, depending upon your specific situation and requirements, it may be that it is also necessary to consider the usefulness of putting in place other Powers of Attorney, including General Powers of Attorney, Enduring Medical Treatment Powers of Attorney and Enduring Powers of Guardianship.

Do you know What is a Irrevocable Trust? If you don’t, you are not the only person. Many people that do not have an understanding of what the meaning of an irrevocable trust is.

Although you may not know the meaning of the word, you have probably heard of trust before. When it comes to trusts there are two kinds. One of them is revocable and the other is irrevocable.

Now to give you a better understanding, it is important to get the gist of what a trust is. A trust involves a legal arrangement that a person makes for the things they own for when they die. This arrangement comes down to a written document, called either Trust agreement, or a Declaration of trust.

The individual who makes the document and bares the estate is the trustor or grantor that is listed. The other individual, who is given rights to the property for someone else, is listed as the trustee. This person has the obligation to protect the assets that are transferred within the trust.

Irrevocable trusts differ slightly than the general definition of a trust. Irrevocable trusts are when the grantor, or trustor no longer has legal control over the assets. This applies even in the case the person is alive.

There is still a trustee involved, who has the responsibility of managing the assets in the best interest for the beneficiary. The trustee should carry out the wishes of the trustor. Additionally, some tax benefits come along with these kinds of trusts.

The U.S. government reacted to the terrorist attacks of 9/11 with several policy and law changes. Those changes have had an enormous and direct impact upon U.S. citizenship and immigration. Show your strong support with custom trading pins and learn more about the country’s history.

The most sweeping change after 9/11 was the U.S. Patriot Act, signed into law on September 26, 2001. While this Act was designed to protect against terrorism, it also has had a negative impact on immigrants. The Act allows law enforcement agencies more power to search telephone communications, e-mails, medical, financial, and other records. The Act limits restrictions on foreign intelligence gathering within the United States, and it gave more discretion to law enforcement and immigration authorities in detaining and deporting immigrants suspected of terrorism-related acts. The Act called for Special Registrations, deportations, fingerprinting and questioning of certain non-citizens, particularly males in certain age groups. The Act was was reauthorized by Congress in 2005.

The U.S. Patriot Act contains immigration provisions that allow for the indefinite detention of any alien whom the Attorney General believes may cause a terrorist act. The Act has been challenged on several legal grounds but remains largely intact.

The U.S. government continues to fight terrorism by tightening its policies on foreigners in our country. Obtaining visas and green cards now involve a complicated process, with more detailed background checks being required. For example, the U.S. government will quickly deport individuals for visa or green card violations.

The Patriot Act and other post 9/11 policies still have a negative impact on the immigrant population. Since 9/11, immigration laws have become more complicated. Obtaining a fiance visa, for example, has become harder, simply due to increased regulation and tighter immigration requirements. Thus, the need for an experienced immigration attorney is greater now than ever.

After you become a landed immigrant, you must apply for three very important pieces of IDs: a permanent resident card, a SIN card and a health card.

The Permanent Resident Card

This card will be the easiest to obtain, because you don’t need to apply for it! Once you become a landed immigrant, the officer at the entry point will ask you for an address and you will receive the card automatically, free of charge. And that’s it!

The Permanent Residence card is the proof of your status in Canada. It expires every five year.

You SIN Card

A Social Insurance Number (SIN) is a 9 digit number issued by the Canadian government that you need to work in Canada. It is very important that you apply for your Social Insurance Number card as soon as you can.

You may apply for a SIN card at any Service Canada Center. Permanent Residents in Canada will need:

The Permanent Resident Card issued by Citizenship and Immigration Canada, or

The Confirmation of Permanent Residence and visa counterfoil affixed to your passport

You will receive a SIN number right away if you apply in person. You will then receive the card by mail within ten days.

You may also apply by mail, by downloading the application form and sending the supporting documents. It will take about 15 business days.

There is no fee to apply for a SIN number and to get a first SIN card.

Be aware that identity thief is a serious problem, so take care of your SIN number. Only provide you SIN number when it is legally required, for example, by your employer, financial institutions and tax services. You do not have to give your SIN number to complete a job application, or to apply for credit cards.

The Health Card

Health Cards are issued by the provincial or territorial government and allow access to insured health care services. Each province or territory manages its own health system.

Because this is a provincial matter, regulations and requirement vary. Generally speaking, as a permanent resident, you are entitled to a range of health care services paid for by your provincial health ministry. Typically hospitalizations, surgeries, visits to your general practitioner, emergency visits etc are covered, which means that you just have to show your health card when using the services, and that you will not pay. Services which are not generally covered are eye exams, dentistry and cosmetic surgery. If you wish to be covered for additional services, you may buy private health insurance.

Everyone must have their own health cards, including babies.

Note that you may not be eligible for health care right after you arrive. Some provinces require a waiting, during which you will not be covered. For example, in Ontario, coverage normally becomes effective three months after the date you establish residency in the province. New and returning residents are encouraged to purchase private health insurance in case you become ill during the waiting period.

In order to maintain your insurance coverage, most provinces requires that you make your primary residence in that province and that you meet physical presence requirements.

These are the most important IDs you should apply for when arriving in Canada. You will need them to work, prove your status, prove that you are entitled to benefits etc. So take a moment to do the paperworks!

In an effort to modernize the Thai Immigration system, officials in Thailand have promulgated rules which have precluded some foreigners from remaining in the Kingdom for long periods of time.

In recent months there have been many changes in Thailand’s Immigration and Visa regulations. Most notable among these changes has been the virtual destruction of the infinite visa exemptions once granted by Royal Thai Immigration authorities at border checkpoints. At one point, it was possible for a foreign national to obtain three Thai thirty day visa exemptions before being forced to depart the Kingdom, obtain a visa, and reenter in lawful status. At this time, this scheme is no longer the way Thai Immigration deals with those entering on visa exemptions.

At this moment, Royal Thai Immigration officers are allowing multiple visa exemption stamps. However, these stamps are only valid for 15 days. Instead, they currently allow entrants to gain admission to the Kingdom, but only for 15 days at land borders and 30 days at airports.

The result of this state of affairs was an increasing number of prospective visitors applied for tourist visas outside of Thailand. Consulates and Embassies in the ASEAN countries have seen a dramatic rise in Tourist visa applications as well as approvals. The most interesting aspect of this situation was the fact that this upsurge in Tourist visa applications also coincided with a program instituted by the Thai government to give away free tourist visas. As a result, Consular posts outside of Thailand were taking processing a larger number of cases and being paid less money. Although a Consulate is not a strictly “for profit” enterprise, the lack of funding and heavier workload may explain why Consulates began scrutinizing Tourist visa applications more closely. This problem became particularly acute at notorious “visa run” posts. The Thai Consulate-General in Penang, Malaysia has made stringent rules restricting the issuance of multiple tourist visas as the post believed that there were some foreigners abusing the system.

This leaves the prospective traveler asking themselves: What do I do to get a long term Thai visa? The best advice: plan ahead. It is often easiest to obtain a long term Thai visa from a post in the applicant’s home country. Even though there exceptions to any rule, a prospective long term tourist generally has the best luck in obtaining a visa from his or her home country. However, there are some types of visas that can be easily obtained and some types that cannot be easily acquired. The 3 year multiple entry business visa is an example of the type of visa that is not generally granted. A Thai business visa with a validity of 1 year is more easily acquired by prospective travelers, but even this type of visa requires sponsorship by a company in Thailand and some companies are reluctant to act as sponsors.
